Missing Work

While you participate in the jury selection process and serve as a juror, your employer must keep your current position or make a comparable position available to you when you return to work. This means your employer must give you time off to serve as a juror.

The Employment Standards Act states you are on unpaid leave while on jury duty and you cannot be terminated from your position.

Although your employer does not legally have to pay you, you are considered to be continuously employed while you are a juror. Also, your employer must continue to apply the same calculations for vacation, salary increases, pension, medical and other benefit plan entitlements.

If your employer wants to change any of your conditions of employment they must get your written consent.

The Employment Insurance Act states that if you are receiving employment insurance benefits, you will still be allowed to get these benefits while on jury duty.
